Acceptable Use Policy
This Acceptable Use Policy ("AUP") defines the acceptable and prohibited uses of the Atlas Digital Vault Service ("Service"). This AUP is incorporated into and forms an integral part of the Terms of Service. By using the Service, you agree to comply with this policy in its entirety. This policy is governed by the laws of the United Republic of Tanzania, including the Cybercrimes Act, 2015, the Personal Data Protection Act, 2023 (PDPA), and the Electronic and Postal Communications Act (EPOCA).
1. Purpose of the Service
Atlas Digital Vault is designed to be a secure, zero-knowledge encrypted document vault for storing, organizing, and managing personal and professional documents. The Service is intended exclusively for the lawful storage of legitimate documents such as:
- Government-issued identification documents (passports, national IDs, driver's licenses, voter cards).
- Medical and health records.
- Educational certificates, transcripts, and diplomas.
- Financial documents (bank statements, tax records, insurance policies, receipts).
- Legal documents (contracts, agreements, property deeds, title deeds, court orders).
- Personal documents (family photographs, birth certificates, marriage certificates, personal correspondence).
- Professional documents (business records, licenses, certifications, employment contracts).
- Vehicle documents (registration, insurance, inspection certificates).
2. User Responsibility for Content
You are solely, exclusively, and entirely responsible for all Content you upload, store, transmit, or share through the Service. Due to our zero-knowledge encryption architecture, Atlas Digital Vault cannot and does not inspect, review, monitor, filter, or screen the contents of your encrypted documents. This means:
- You bear complete legal responsibility for ensuring that all Content you store complies with all applicable laws of the United Republic of Tanzania and any other applicable jurisdiction.
- You represent and warrant that you have the legal right to possess and store all Content in your vault.
- You represent and warrant that your Content does not infringe, misappropriate, or violate any third-party intellectual property rights, privacy rights, or other legal rights.
- If you store documents belonging to another person, you represent and warrant that you have obtained lawful authorization from that person to do so.
3. Prohibited Uses
You shall not use the Service for any purpose that is unlawful, harmful, or otherwise prohibited by this policy. Prohibited uses include, but are not limited to:
3.1 Illegal Content and Criminal Activity
- Storing, transmitting, or distributing any content that is illegal under the laws of the United Republic of Tanzania, the Cybercrimes Act 2015, or the jurisdiction in which you reside.
- Storing child sexual abuse material (CSAM) or any content depicting or facilitating the exploitation of minors.
- Storing content that facilitates or promotes terrorism, violent extremism, or organized crime.
- Using the Service to facilitate fraud, identity theft, forgery, counterfeiting, money laundering, or other financial crimes.
- Storing forged, counterfeit, altered, or fraudulently obtained documents.
- Storing stolen documents or documents belonging to another person without their lawful consent.
- Using the Service to plan, coordinate, or facilitate any criminal activity.
- Storing content that violates export control laws, sanctions, or trade restrictions.
3.2 Unauthorized Document Storage
IMPORTANT: The following activities are strictly prohibited and may result in immediate account termination and referral to law enforcement:
- Uploading documents that belong to another person without their explicit, informed consent.
- Storing copies of other people's identification documents, financial records, or personal documents for purposes of identity theft, fraud, blackmail, or any other unlawful purpose.
- Using the Service as a repository for documents obtained through theft, hacking, social engineering, or any other unlawful means.
If any person uploads another person's documents to the Service without authorization, that person — not Atlas Digital Vault — bears sole and exclusive criminal and civil liability for such action under the Cybercrimes Act 2015, the PDPA, and any other applicable law.
3.3 Harmful Technical Activities
- Attempting to bypass, disable, or circumvent any security features of the Service.
- Attempting to gain unauthorized access to other users' accounts, data, or vaults.
- Introducing malware, viruses, worms, trojans, ransomware, or other malicious code.
- Conducting denial-of-service attacks or any activity that disrupts, degrades, or overburdens the Service.
- Using the Service to distribute spam, phishing messages, or unsolicited communications.
- Scraping, crawling, or using automated tools to access the Service without written authorization.
3.4 Misuse of Resources
- Using the Service as a general-purpose file hosting, content delivery, or file-sharing platform.
- Sharing your account credentials with unauthorized third parties.
- Creating multiple free accounts to circumvent plan limitations.
- Reselling, sublicensing, or redistributing access to the Service without written authorization.
- Using the Service in any manner that places an unreasonable or disproportionate burden on our infrastructure.
- Using the API in a manner that exceeds published rate limits or is otherwise abusive.
3.5 Intellectual Property Violations
- Storing content that infringes on the intellectual property rights of others (e.g., pirated software, copyrighted materials you do not have rights to).
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of any part of the Service.
- Removing or altering any proprietary notices, labels, trademarks, or marks on the Service.
4. Shared Links — User Responsibility
The Service allows you to create Shared Links that grant third-party access to specific documents. Your responsibilities regarding Shared Links include:
- You are solely responsible for all Shared Links you create and the consequences of sharing them.
- You must not share links to documents containing another person's personal data without that person's explicit consent.
- You must use appropriate security measures (passwords, expiration times) when sharing sensitive documents.
- If a Shared Link you created results in unauthorized access to personal data, you bear full liability under the PDPA and the Cybercrimes Act 2015.
- Atlas Digital Vault is not responsible for monitoring, restricting, or controlling access to your Shared Links.
- You must immediately disable any Shared Link if you become aware of unauthorized or unintended access.
5. Zero-Knowledge Considerations
Due to our zero-knowledge architecture, we cannot inspect the content of your encrypted documents. However:
- This AUP applies fully regardless of our technical ability to enforce it through content inspection.
- We may take action based on account metadata, usage patterns, reports from users or third parties, or requests from law enforcement authorities.
- We reserve the right to suspend or terminate accounts when we have reasonable grounds to believe this AUP is being violated, even without inspecting encrypted content.
- Law enforcement requests will be handled in accordance with applicable Tanzanian law, including the Cybercrimes Act 2015, and our Privacy Policy.
- Our inability to inspect content does not diminish your legal obligations or absolve you of liability for prohibited content.
6. Reporting Violations
If you believe another user is violating this AUP, please report it to us:

- Include as much detail as possible about the suspected violation.
We take all reports seriously and will investigate promptly. Reports can be submitted anonymously. We will not disclose the identity of the reporter to the accused user except as required by law.
7. Enforcement
We reserve the right to take any of the following actions if we determine, in our sole discretion, that a violation of this AUP has occurred or is reasonably likely to occur:
- Warning: Issuing a written warning specifying the violation and requesting immediate corrective action.
- Temporary Suspension: Temporarily suspending access to the Service while we investigate the alleged violation.
- Permanent Termination: Permanently terminating your account without refund. Encrypted data may be retained for 30 days as specified in our Terms of Service.
- Law Enforcement Referral: Reporting violations to the Tanzania Police Force, the Prevention and Combating of Corruption Bureau (PCCB), the Financial Intelligence Unit (FIU), or other appropriate law enforcement authorities.
- Legal Action: Pursuing civil remedies, including injunctive relief and damages.
We will attempt to provide notice before taking enforcement action, except in cases where:
- Immediate action is necessary to protect the Service, our users, or the public.
- Notice would compromise a law enforcement investigation.
- The violation involves illegal content or criminal activity.
8. User Responsibilities
You are responsible for:
- Ensuring that your use of the Service complies with all applicable laws and regulations of the United Republic of Tanzania and any other applicable jurisdiction.
- Maintaining the security and confidentiality of your account credentials.
- All actions taken by anyone who accesses the Service through your account, whether authorized or unauthorized.
- The content and consequences of all documents you upload, store, or share.
- Understanding and complying with this AUP and all other policies referenced herein.
9. API Usage
If you access the Service through our API at api.atlasdigitalvault.app, you must additionally:
- Comply with all published API documentation and rate limits.
- Authenticate all API requests properly using valid credentials.
- Not use the API to build a competing service or derivative product.
- Not share your API credentials with unauthorized parties.
- Handle API errors gracefully and implement appropriate exponential backoff strategies.
- Not attempt to circumvent rate limits or access controls.
10. Storage Limits
Each subscription plan has defined storage and document count limits. You must stay within the limits of your plan. If you exceed your plan limits, you will be notified and asked to either reduce your usage or upgrade your plan. Continued violation of storage limits may result in restriction of upload capabilities until compliance is restored.
11. Indemnification
You agree to indemnify and hold harmless Atlas Digital Vault from any claims, damages, losses, or expenses arising from your violation of this AUP, including but not limited to legal fees, regulatory fines, and third-party claims resulting from Content you uploaded or Shared Links you created.
12. Changes to This Policy
We may update this Acceptable Use Policy from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified AUP.

Sera ya Matumizi Yanayokubalika
Sera hii ya Matumizi Yanayokubalika ("SMA") inafafanua matumizi yanayokubalika na yaliyokatazwa ya Huduma ya Atlas Digital Vault ("Huduma"). SMA hii imejumuishwa na inafanya sehemu muhimu ya Masharti ya Huduma. Kwa kutumia Huduma, unakubali kufuata sera hii kwa ukamilifu wake. Sera hii inaongozwa na sheria za Jamhuri ya Muungano wa Tanzania, ikiwa ni pamoja na Sheria ya Makosa ya Mtandao, 2015, Sheria ya Ulinzi wa Data Binafsi, 2023 (PDPA), na Sheria ya Mawasiliano ya Kielektroniki na Posta (EPOCA).
1. Madhumuni ya Huduma
Atlas Digital Vault imeundwa kuwa hifadhi salama ya nyaraka iliyosimbwa kwa njia ya sifuri-maarifa kwa kuhifadhi, kupanga, na kusimamia nyaraka za kibinafsi na za kitaaluma. Huduma hii imekusudiwa tu kwa uhifadhi halali wa nyaraka halisi kama vile:
- Nyaraka za utambulisho zilizotolewa na serikali (pasipoti, vitambulisho vya taifa, leseni za udereva, kadi za mpiga kura).
- Rekodi za matibabu na afya.
- Vyeti vya elimu, matokeo ya mitihani, na diploma.
- Nyaraka za kifedha (taarifa za benki, rekodi za kodi, sera za bima, risiti).
- Nyaraka za kisheria (mikataba, makubaliano, hati za mali, hati za ardhi, amri za mahakama).
- Nyaraka za kibinafsi (picha za familia, vyeti vya kuzaliwa, vyeti vya ndoa, barua za kibinafsi).
- Nyaraka za kitaaluma (rekodi za biashara, leseni, vyeti, mikataba ya ajira).
- Nyaraka za magari (usajili, bima, vyeti vya ukaguzi).
2. Wajibu wa Mtumiaji kwa Maudhui
Wewe peke yako, kwa ukamilifu, na kwa ujumla unawajibika kwa Maudhui yote unayopakia, kuhifadhi, kutuma, au kushiriki kupitia Huduma. Kwa sababu ya muundo wetu wa usimbaji wa sifuri-maarifa, Atlas Digital Vault haiwezi na haichunguzi, hakagui, haisimamii, haichui, au kukagua maudhui ya nyaraka zako zilizosimbwa. Hii inamaanisha:
- Unabeba wajibu kamili wa kisheria wa kuhakikisha kuwa Maudhui yote unayohifadhi yanafuata sheria zote zinazotumika za Jamhuri ya Muungano wa Tanzania na mamlaka nyingine yoyote inayotumika.
- Unawakilisha na kudhamini kuwa una haki ya kisheria ya kumiliki na kuhifadhi Maudhui yote katika hifadhi yako.
- Unawakilisha na kudhamini kuwa Maudhui yako hayakiuki, hayachukui bila idhini, au hayavunji haki yoyote ya miliki ya kiakili ya watu wengine, haki za faragha, au haki nyingine za kisheria.
- Ikiwa unahifadhi nyaraka za mtu mwingine, unawakilisha na kudhamini kuwa umepata idhini halali kutoka kwa mtu huyo kufanya hivyo.
3. Matumizi Yaliyokatazwa
Hutaruhusiwa kutumia Huduma kwa madhumuni yoyote ambayo ni kinyume cha sheria, yenye madhara, au yaliyokatazwa vinginevyo na sera hii. Matumizi yaliyokatazwa yanajumuisha, lakini si tu:
3.1 Maudhui Haramu na Shughuli za Uhalifu
- Kuhifadhi, kutuma, au kusambaza maudhui yoyote ambayo ni haramu chini ya sheria za Jamhuri ya Muungano wa Tanzania, Sheria ya Makosa ya Mtandao 2015, au mamlaka ambayo unaishi.
- Kuhifadhi nyenzo za unyanyasaji wa kingono wa watoto (CSAM) au maudhui yoyote yanayoonyesha au kuwezesha unyonyaji wa watoto.
- Kuhifadhi maudhui yanayowezesha au kukuza ugaidi, msimamo mkali wa vurugu, au uhalifu wa kupangwa.
- Kutumia Huduma kuwezesha udanganyifu, wizi wa utambulisho, kughushi, kutengeneza bandia, utakatishaji wa fedha haramu, au makosa mengine ya kifedha.
- Kuhifadhi nyaraka zilizoghushiwa, za bandia, zilizobadilishwa, au zilizopatikana kwa udanganyifu.
- Kuhifadhi nyaraka zilizoibwa au nyaraka za mtu mwingine bila ridhaa yake halali.
- Kutumia Huduma kupanga, kuratibu, au kuwezesha shughuli yoyote ya uhalifu.
- Kuhifadhi maudhui yanayokiuka sheria za udhibiti wa mauzo nje ya nchi, vikwazo, au vizuizi vya biashara.
3.2 Uhifadhi Usioidhinishwa wa Nyaraka
MUHIMU: Shughuli zifuatazo zimekatazwa kabisa na zinaweza kusababisha kufungwa kwa akaunti mara moja na kuripotiwa kwa vyombo vya sheria:
- Kupakia nyaraka za mtu mwingine bila ridhaa yake dhahiri na ya kuelewa.
- Kuhifadhi nakala za nyaraka za utambulisho, rekodi za kifedha, au nyaraka za kibinafsi za watu wengine kwa madhumuni ya wizi wa utambulisho, udanganyifu, usaliti, au madhumuni mengine yoyote haramu.
- Kutumia Huduma kama hifadhi ya nyaraka zilizopatikana kupitia wizi, udukuzi, uhandisi wa kijamii, au njia nyingine yoyote isiyo halali.
Ikiwa mtu yeyote anapakia nyaraka za mtu mwingine kwenye Huduma bila idhini, mtu huyo — si Atlas Digital Vault — anabeba wajibu wa pekee na wa kipekee wa jinai na madeni kwa kitendo hicho chini ya Sheria ya Makosa ya Mtandao 2015, PDPA, na sheria nyingine yoyote inayotumika.
3.3 Shughuli Hatari za Kiufundi
- Kujaribu kupita, kuzima, au kukwepa vipengele vyovyote vya usalama vya Huduma.
- Kujaribu kupata ufikiaji usioidhinishwa wa akaunti, data, au hifadhi za watumiaji wengine.
- Kuingiza programu hasidi, virusi, minyoo, trojani, ransomware, au msimbo mwingine hatari.
- Kufanya mashambulizi ya kukataa huduma au shughuli yoyote inayotatiza, kudhoofisha, au kulemea Huduma.
- Kutumia Huduma kusambaza barua taka, ujumbe wa ulaghai, au mawasiliano yasiyoombwa.
- Kukwapua, kutambaa, au kutumia zana za kiotomatiki kufikia Huduma bila idhini ya maandishi.
3.4 Matumizi Mabaya ya Rasilimali
- Kutumia Huduma kama jukwaa la kawaida la uhifadhi wa faili, utoaji wa maudhui, au kushiriki faili.
- Kushiriki nywila za akaunti yako na watu wengine wasioidhinishwa.
- Kuunda akaunti nyingi za bure ili kukwepa vizuizi vya mpango.
- Kuuza tena, kutoa leseni ndogo, au kusambaza tena ufikiaji wa Huduma bila idhini ya maandishi.
- Kutumia Huduma kwa njia yoyote inayoweka mzigo usio wa busara au usio na uwiano kwenye miundombinu yetu.
- Kutumia API kwa njia inayozidi vikomo vilivyochapishwa vya viwango au vinginevyo ni ya unyanyasaji.
3.5 Ukiukaji wa Miliki ya Kiakili
- Kuhifadhi maudhui yanayokiuka haki za miliki ya kiakili za wengine (k.m., programu za korsani, nyenzo zenye hakimiliki ambazo huna haki nazo).
- Kurejesha uhandisi, kutenganisha, kubomoa, au vinginevyo kujaribu kupata msimbo wa chanzo wa sehemu yoyote ya Huduma.
- Kuondoa au kubadilisha arifa zozote za umiliki, lebo, alama za biashara, au alama kwenye Huduma.
4. Viungo vya Kushiriki — Wajibu wa Mtumiaji
Huduma inakuruhusu kuunda Viungo vya Kushiriki vinavyowapa watu wengine ufikiaji wa nyaraka maalum. Wajibu wako kuhusu Viungo vya Kushiriki ni pamoja na:
- Wewe peke yako unawajibika kwa Viungo vyote vya Kushiriki unavyounda na matokeo ya kuvishiriki.
- Hauruhusiwi kushiriki viungo vya nyaraka zenye data binafsi ya mtu mwingine bila ridhaa dhahiri ya mtu huyo.
- Lazima utumie hatua zinazofaa za usalama (nywila, muda wa kumalizika) unaposhiriki nyaraka nyeti.
- Ikiwa Kiungo cha Kushiriki ulichounda kinasababisha ufikiaji usioidhinishwa wa data binafsi, unabeba dhima kamili chini ya PDPA na Sheria ya Makosa ya Mtandao 2015.
- Atlas Digital Vault haiwajibiki kufuatilia, kuzuia, au kudhibiti ufikiaji wa Viungo vyako vya Kushiriki.
- Lazima uzime Kiungo chochote cha Kushiriki mara moja ukigundua ufikiaji usioidhinishwa au usiokusudiwa.
5. Mazingatio ya Sifuri-Maarifa
Kwa sababu ya muundo wetu wa sifuri-maarifa, hatuwezi kukagua maudhui ya nyaraka zako zilizosimbwa. Hata hivyo:
- SMA hii inatumika kikamilifu bila kujali uwezo wetu wa kiufundi wa kuitekeleza kupitia ukaguzi wa maudhui.
- Tunaweza kuchukua hatua kulingana na metadata ya akaunti, mifumo ya matumizi, ripoti kutoka kwa watumiaji au watu wengine, au maombi kutoka kwa mamlaka za utekelezaji wa sheria.
- Tunahifadhi haki ya kusimamisha au kufunga akaunti tunapokuwa na sababu za msingi za kuamini SMA hii inakiukwa, hata bila kukagua maudhui yaliyosimbwa.
- Maombi ya utekelezaji wa sheria yatashughulikiwa kulingana na sheria zinazotumika za Tanzania, ikiwa ni pamoja na Sheria ya Makosa ya Mtandao 2015, na Sera yetu ya Faragha.
- Kutoweza kwetu kukagua maudhui hakupunguzi wajibu wako wa kisheria au kukuondolea dhima kwa maudhui yaliyokatazwa.
6. Kuripoti Ukiukaji
Ikiwa unaamini mtumiaji mwingine anakiuka SMA hii, tafadhali turipotie:
- Barua pepe: [email protected]
- Mstari wa somo: "Ripoti ya Ukiukaji wa SMA"
- Jumuisha maelezo mengi iwezekanavyo kuhusu ukiukaji unaoshukiwa.
Tunachukulia ripoti zote kwa uzito na tutachunguza haraka. Ripoti zinaweza kutumwa bila kutaja jina. Hatutafichua utambulisho wa mripoti kwa mtumiaji anayeshtakiwa isipokuwa inavyotakiwa na sheria.
7. Utekelezaji
Tunahifadhi haki ya kuchukua hatua yoyote kati ya zifuatazo ikiwa tutaamua, kwa uamuzi wetu pekee, kuwa ukiukaji wa SMA hii umetokea au una uwezekano mkubwa wa kutokea:
- Onyo: Kutoa onyo la maandishi linalobainisha ukiukaji na kuomba hatua ya kurekebisha mara moja.
- Kusimamishwa kwa Muda: Kusimamisha kwa muda ufikiaji wa Huduma wakati tunachunguza ukiukaji unaodaiwa.
- Kufungwa Kabisa: Kufunga akaunti yako milele bila kurudishiwa fedha. Data iliyosimbwa inaweza kuhifadhiwa kwa siku 30 kama ilivyoainishwa katika Masharti yetu ya Huduma.
- Kuripotiwa kwa Vyombo vya Sheria: Kuripoti ukiukaji kwa Jeshi la Polisi la Tanzania, Taasisi ya Kuzuia na Kupambana na Rushwa (TAKUKURU), Kitengo cha Taarifa za Fedha (FIU), au mamlaka nyingine zinazofaa za utekelezaji wa sheria.
- Hatua za Kisheria: Kufuata dawa za kiraia, ikiwa ni pamoja na amri za mahakama na fidia.
Tutajaribu kutoa notisi kabla ya kuchukua hatua za utekelezaji, isipokuwa katika hali ambapo:
- Hatua ya haraka inahitajika kulinda Huduma, watumiaji wetu, au umma.
- Notisi ingehatarisha uchunguzi wa vyombo vya sheria.
- Ukiukaji unahusisha maudhui haramu au shughuli za uhalifu.
8. Wajibu wa Mtumiaji
Unawajibika kwa:
- Kuhakikisha kuwa matumizi yako ya Huduma yanafuata sheria na kanuni zote zinazotumika za Jamhuri ya Muungano wa Tanzania na mamlaka nyingine yoyote inayotumika.
- Kudumisha usalama na usiri wa nywila za akaunti yako.
- Hatua zote zinazochukuliwa na mtu yeyote anayefikia Huduma kupitia akaunti yako, iwe ameidhinishwa au la.
- Maudhui na matokeo ya nyaraka zote unazopakia, kuhifadhi, au kushiriki.
- Kuelewa na kufuata SMA hii na sera nyingine zote zinazorejelewa hapa.
9. Matumizi ya API
Ikiwa unafikia Huduma kupitia API yetu kwenye api.atlasdigitalvault.app, lazima pia:
- Kufuata nyaraka zote zilizochapishwa za API na vikomo vya viwango.
- Kuthibitisha maombi yote ya API ipasavyo kwa kutumia nywila halali.
- Usitumie API kujenga huduma shindani au bidhaa inayotokana.
- Usishiriki nywila zako za API na watu wasioidhinishwa.
- Kushughulikia makosa ya API kwa uangalifu na kutekeleza mikakati inayofaa ya kurudi nyuma kwa kielelezo.
- Usijaribu kukwepa vikomo vya viwango au udhibiti wa ufikiaji.
10. Vikomo vya Hifadhi
Kila mpango wa usajili una vikomo vilivyofafanuliwa vya uhifadhi na idadi ya nyaraka. Lazima ubaki ndani ya vikomo vya mpango wako. Ukizidi vikomo vya mpango wako, utaarifiwa na kuombwa kupunguza matumizi yako au kuboresha mpango wako. Ukiukaji unaoendelea wa vikomo vya hifadhi unaweza kusababisha kuzuiwa kwa uwezo wa kupakia hadi utakapofuata tena.
11. Fidia
Unakubali kufidia na kumlinda Atlas Digital Vault dhidi ya madai yoyote, uharibifu, hasara, au gharama zinazotokana na ukiukaji wako wa SMA hii, ikiwa ni pamoja na lakini si tu ada za kisheria, faini za udhibiti, na madai ya wahusika wengine yanayotokana na Maudhui uliyopakia au Viungo vya Kushiriki ulivyounda.
12. Mabadiliko ya Sera Hii
Tunaweza kusasisha Sera hii ya Matumizi Yanayokubalika mara kwa mara. Tutakuarifu kuhusu mabadiliko muhimu kwa barua pepe au kupitia Huduma angalau siku 30 kabla ya mabadiliko kuanza kutumika. Kuendelea kwako kutumia Huduma baada ya tarehe ya kuanza kutumika kunajumuisha kukubali SMA iliyorekebishwa.
